OPTIONAL ESSAY

As indicated in the course outline, you have the option of writing a paper. For ease of reference, the course outline provides as follows:

ESSAY OPTION: A STUDENT MAY SELECT THE ESSAY OPTION SIMPLY BY SUBMITTING THE ESSAY ON THE DUE DATE OF MARCH 12, 2020. STUDENTS NOT SUBMITTING A PAPER BY 11:59 PM ON MARCH 12 WILL BE DEEMED TO HAVE DECLINED THE OPTION. THE ONLY WAY TO CHOOSE THE OPTION IS BY SUBMITTING THE PAPER ON TIME. EMAILS, WRITTEN NOTES, TEXTS AND COMMUNICATIONS OF ANY KIND OTHER THAN SUBMISSION OF THE PAPER SHALL NOT CONSTITUTE SELECTION OF THE ESSAY OPTION.

IF AND ONLY IF THE ESSAY OPTION IS SELECTED BY THE DUE DATE. THE MARK ALLOCATION WILL BE AS FOLLOWS:

PARTICIPATION 10%

MIDTERM EXAMINATION: 30% ON FEB 13, 2020

FINAL EXAMINTION: 40% DURING FORMAL EXAM PERIOD

ESSAY 20% NO LATER THAN MARCH 12 @ 11:59 PM

IF THE ESSAY OPTION IS NOT CHOSEN, THE MIDTERM AND FINAL ARE WORTH 40% AND 50% RESPECTIVELEY.

You may choose one of two essay options:

1. Review and summarize the case of Tesla Motors Canada ULC v. Ontario (Ministry of Transportation), [2018] O.J. No. 4394, 2018 ONSC 5062 and explain how the case is an expression of the rule of law, basing your observations on your research of the rule of law.

OR

2. Review the following book: Schwisberg. Samuel, “Swarm Before Me” 2015 published by Friesen Press, available on-line at Amazon, iTunes bookstore, Google Play, the Nook Store, or the Kobo Store where the e-book is available for about $5.00 I also have 6 copies I can loan out – first come, first served. Describe how the litigation process unfolded in Becker v. Pettkus as described in the book.

In your opinion, would any of the ADR processes likely have produced a better result in Becker v. Pettkus than did the civil litigation process? Why or why not?

Your paper should be around 12 pages in length, font Arial 12, and will be graded on the strength of your logic and arguments and demonstrated understanding of the material and subject. For option 1, the strength of your research will also be a consideration.
