of its powers, the adoption of a federal system, the proclamation of civil liberties and rights, and the

These instances may include, for example, executive overreach, judicial activism (or restraint), one
branch’s failure to oversee another or to perform their mandated duties, or national government
meddling into states spheres of authority, among others.
